NOTICE OF PRIVACY PRACTICES

IMPORTANT: THIS NOTICE DESCRIBES HOW PROTECTED HEALTH INFORMATION ABOUT ALL PEOPLE WE SUPPORT MAY BE USED AND DISCLOSED AND HOW THEY CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

As an essential part of our commitment to you, Birch Family Services maintains the privacy of certain confidential health care information about  the people we support, known as Protected Health Information (PHI). We  also maintain the privacy of  any/all personally identifiable information (PII) to the best of our ability.  We are required by law to protect this health care information and to provide  all people we support  with the attached Notice of Privacy Practices (NPP or The Notice).

The Notice outlines our legal duties and privacy practices in respect to PHI and PII of the people we support. It not only describes our privacy practices and legal rights, but outlines, among other things, how Birch Family Services is permitted to use and disclose the PHI, how one can access and copy that information, may request amendment of that information, may choose the manner in which that information is disclosed and may request restrictions on our use and disclosure of the PHI.

Birch Family Services is also required to abide by the terms of the version of this Notice currently in effect. In most situations we may use this information as described in this Notice without permission, but there are some situations where we may use it only after we obtain our service recipients written authorization, if we are required by law to do so.

We respect the  privacy  of all of the  people we support  and treat all health care information  under strict policies of confidentiality that all of our staff are committed to following at all times.

Birch Family Services (Birch) is committed to maintaining the privacy of confidential information about the students and person’s supported by Birch, including but not limited to protected health information (PHI) and/or any personally identifiable information (PII). Birch implements procedures to safeguard such information during the collection, recording, storage and appropriate disclosure of records that contain PHI/PII, that evidence compliance with all local, city, state and federal laws and requirements including HIPAA (Health Insurance Portability and Accountability Act) and FERPA (Family Educational Rights and Privacy Act) . In addition to posting our NPP, to comply with Education Law §2-d, Part 121 regulations, Birch has adopted a Data Privacy and Security Policy, and a Family Bill of Rights for Data Privacy which are posted on this page. The policy provides an overview of the principles, processes and solutions that facilitate secure business operations and applies to all employees, interns, contractors, volunteers, vendors. This policy is used to manage the confidentiality, integrity and availability associated with information assets.
